MOORING RULES AND REGULATIONS

This policy applies to all members of the Bacon Hill Homeowners’ Association.  The Association maintains appropriate permits from the DEC and other appropriate regulatory bodies for a mooring field in our commonly owned littoral rights in Skaneateles Lake. The purpose of this policy is to guide decisions regarding fair assignment, maintenance and transfer of mooring sites in the commonly owned mooring field.

 

A. ACCESS TO A MOORING SITE

  1. Members that are assigned a mooring site at either the Main Beach or the North Annex Mooring Field will continue to occupy that space INDEFINITELY subject to the following guidelines:

  2. Eligibility: A property owner must be a member in good standing to be eligible for a mooring site. Rental tenants of Member properties may not use the moorings.

  3. Transferability: Mooring sites are NOT transferrable upon purchase of a new property. When a property that is occupying a mooring site is sold the mooring site is offered to the next member on the waiting list. An occupant can only be assigned one mooring, regardless of how many properties they own.

  4. Sale of Property: Owners of multiple properties may sell off their properties without losing their mooring. As long as a member owns one property, they will not forfeit their mooring.

  5. Bacon Hill mooring fields utilize traditional ‘swing buoys’ designed to accommodate boats in the ‘Class 1’ category of boats (boats 16’ to less than 26’) of the four designations of boats. Pursuant to the Mooring Policy, all other class of boats (Class A under 16', Class 2 & Class 3 26' & larger) are not eligible for mooring in the BHHA mooring fields. 

  6. Status of Boat: A member's boat must be REGISTERED and INSURED. A questionnaire with information regarding your boat and mooring must be on file with the Beach Chair. This form will be provided via the BHHA web site or the Beach Committee.

  7.  Length of vacancy before mooring is reassigned: A mooring may be reclaimed/redistributed if it goes unused for a period of 1 season. Members will be notified, in writing, to the Member’s address on file with the Association, of a pending reclamation. Members so notified may appeal the issue to the BHHA Board of Directors for a waiver but need to do so before the July 1st deadline.

  • A vacant mooring that is deemed to be available will be assigned to the next member on the waiting list. Compensation for the mooring should be negotiated with the previous occupant to the best of your ability. If an agreement can’t be made, BHHA recommends professionally installing new equipment.

  • Members that are not using or don’t plan on using their moorings are encouraged to turn their mooring in for reassignment. Members not using their moorings during the season will be contacted and asked about their future plans.

  • The purpose of this rule is to ensure that assigned moorings are being used. Waivers will only be granted for extreme situations (Extended illnesses, military deployments, major repairs, etc.)

  • Members may loan their mooring to another member; however, this time will count towards their vacancy.

  • Members that are newly assigned to a mooring will be granted a limited grace period to purchase a boat and/or have a mooring installed. New occupants will be informed of their grace period at the time the mooring is assigned. Should they fail to utilize their mooring by the end of the grace period, they will forfeit the mooring to the next member on the waitlist.

  • 8. An official waiting list will be maintained. Members will be added to the list via written request, submitted to the Beach Chair. This list will be updated with the BHHA President as necessary, and reported to the Board of Directors as part of the Beach Committee Report

    • The waiting list will be compiled by DATE OF REQUEST and maintained by the Beach Committee and BHHA President.

    • Members will be informed of their position on the list at the time of request and can inquire with the Beach Chair as to their current position at any time

    • New property owners will not be added to the list until they have officially closed on their property and have paid the balance of their dues.

    • Members on the waiting list can indicate if they have a preference between a mooring in the Main Beach area, the Northern Annex or both.

    • A member may choose to pass and wait for a different mooring should they decide they do not want the mooring that is available.

    • Members with a mooring in the Northern Annex will be allowed to add their name to the waiting list to get a mooring in the main beach area, and they have preference over Members on the waitlist without a current BHHA mooring.

    • Members with a mooring in the main beach area can get on the waiting list for a different mooring location in the main beach area and will have preference for newly opened moorings over both Members on the waiting list to move from the Northern Annex to the main beach area and Members that do not currently have a BHHA mooring.

    • B. MAINTENANCE OF MOORINGS

  1. Any maintenance of a mooring is the responsibility of the assigned member. Mooring materials (mooring ball, chain, etc.) are considered the property of the current occupant.

  2. Moorings must be installed professionally and at the cost of the occupant. The BHHA has used the following installers and recommends them, based on their knowledge of our property:

    • TORY’S ALL SEASONS –            315-857-3483

  3. BHHA strongly suggests that a new occupant’s moorings be professionally inspected at the time of transfer, you will be responsible for any damages that occur if the existing equipment is defective. A price for the equipment should be negotiated with the previous occupant. If a fair price cannot be agreed upon between the parties, the BHHA recommends professionally installing new equipment.

  4. BHHA requires existing moorings be professionally inspected for wear and safety every 3 years, repairs should be made as necessary at the occupant’s expense. The mooring occupant will be held responsible for ANY damages resulting from improper maintenance of their mooring.

  5. Routine inspections of the mooring field can be scheduled by the Beach Chair and the BHHA Board. These inspections may be contracted seasonally or as is convenient/necessary. Occupants will be notified of any causes for concern.

  6. If a mooring is found to be in disrepair or of insufficient weight to properly secure the boat attached to it, causing danger or damages to surrounding vessels, the mooring must be vacated until repairs to/replacement of the mooring can be accommodated. The safety of our members and their property must be the priority. These vacancies WILL count against the vacancy period and will result in forfeiture of the mooring location if not repaired by the following July 1st. Appeals can be made to the board but must be submitted prior to the July 1st deadline.

  7. Moorings that are improperly located or in disrepair must be moved or removed. The Beach Committee will notify occupants if their moorings will be relocated or removed. Every attempt will be made to find suitable locations to accommodate all existing moorings. The Beach Committee will only remove a mooring as a last resort, in an attempt to protect the safety of our members and their property.

  8. Moorings may NOT be relocated by current occupant without the approval of the Beach Chair. The mooring field is carefully balanced to prevent damages. Should a mooring move on its own or an adjustment is necessary the Beach Committee will help all parties in question determine the best course of action.

 

 

 

C. LIABILITY

Members mooring boats in the BHHA mooring fields or storing canoes, kayaks or other watercraft on BHHA property do so at their own risk. BHHA is not responsible for loss or damage done by any cause.

 

D. CHANGES TO POLICY

The BHHA Board reserves the right to expand, amend and update this policy as it sees fit and as circumstances may dictate. In the event substantial changes are made to this policy, members will be notified of changes via the contact information the Board has on file.

 

E. IMPLEMENTATION

This policy will be communicated to the BHHA Stockholders in writing following approval by the Board of Directors. The policy will go into effect as of April 22, 2025.
